  • That any AI implementation will comply with a specific law, regulation, industry standard or client policy; or
  • That any AI system will be suitable for high-risk, regulated, safety-critical or legally significant use without additional assessment, validation and contractual safeguards.

Users and clients are responsible for independent testing, validation, human review, governance, approval, monitoring and lawful deployment of AI-enabled systems, except to the extent expressly agreed in a written contract with Systango.

Blockchain, Web3, Bittensor and digital asset disclaimers

The website may discuss blockchain, Web3, Bittensor, subnets, validators, decentralised AI, smart contracts, digital assets, tokenisation, DeFi, NFT marketplaces, wallets, trading systems, verifiable data, protocol integrations and related technologies.

  • Availability, integrity, accuracy or continuity of any blockchain, protocol, oracle, subnet, validator, wallet, exchange, bridge, marketplace or third-party infrastructure;
  • Compliance with securities, commodities, tax, financial services, virtual asset, anti-money laundering or other applicable laws; or
  • That any blockchain, Web3 or digital asset solution is suitable for any specific regulated use.

Users and clients must obtain independent legal, tax, financial, investment, regulatory, technical and security advice before engaging with blockchain, Web3, Bittensor or digital asset technologies.

Intellectual property

All rights, title and interest in and to the website and its content belong to Systango or its licensors. This includes all text, graphics, logos, icons, images, videos, audio, designs, layouts, interfaces, code, software, data, databases, case studies, reports, whitepapers, blogs, service descriptions, trademarks, trade names and other materials.

Unless expressly stated in writing, such references do not imply endorsement, sponsorship, approval, certification, partnership, authorisation, affiliation or recommendation by the relevant third party.

Systango may update, remove, amend or restrict any client reference, case study, logo, testimonial or portfolio item at its discretion.

User submissions and no confidentiality by default

You may submit information to Systango through website forms, emails, consultation requests, recruitment channels, event forms, resource downloads, proposal discussions or other website-linked channels.

Unless covered by a signed non-disclosure agreement or other written confidentiality agreement with Systango, any information submitted through the website or related public contact channels will not be treated as confidential.

To the maximum extent permitted by law, Systango's total aggregate liability arising out of or in connection with the website, website content, website use, website unavailability, website errors, third-party links, user submissions or these Terms of Use shall not exceed INR 1,000 or the amount paid by you to Systango specifically for access to the website in the twelve months preceding the claim, whichever is higher.

Nothing in these Terms of Use excludes liability that cannot be excluded under applicable law. Where exclusions or limitations are not permitted, liability will be limited to the minimum extent required by applicable law.

Indemnity

You agree to indemnify, defend and hold harmless Systango and its affiliates, directors, officers, employees, contractors, advisers, agents, licensors and service providers from and against all claims, losses, liabilities, damages, penalties, fines, costs and expenses, including reasonable legal fees, arising out of or in connection with:

The invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its intended effect as far as possible.

No waiver

A failure or delay by Systango to enforce any right or provision under these Terms of Use does not constitute a waiver.

Any waiver must be in writing and signed by an authorised representative of Systango.

Assignment

You may not assign or transfer any rights or obligations under these Terms of Use without Systango's prior written consent.

Systango may assign, transfer, subcontract or delegate its rights and obligations under these Terms of Use to any affiliate, successor, acquirer, purchaser, group company or third party in connection with business operations, restructuring, merger, acquisition, sale of assets, investment, financing or corporate transaction.

Governing law and dispute resolution

These Terms of Use are governed by the laws of India.

Subject to the paragraph below, the courts at Indore, Madhya Pradesh shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms of Use, the website or website content.

Notwithstanding the above, Systango may seek interim, injunctive, equitable, protective or urgent relief from any court of competent jurisdiction for matters involving intellectual property, confidentiality, data security, unauthorised access, website misuse, scraping, cyberattacks, unlawful conduct, preservation of evidence or protection of rights.
